The ICCFA was pleased to learn that, based on all our sources, HR 3655 would not be rescheduled for markup with the Energy and Commerce Committee prior to the Memorial Day recess. However, we understand that Congressman Bobby Rush (D-IL) continues to push for the bill's consideration following the recess, which ends on June 4. Therefore, it is important for ICCFA to continue to voice strong opposition to the Rush bill during this time.

Since the members of the House will be back in their home districts during this week, we have a well-timed opportunity to contact our Reps locally to directly express our opposition. We urge you to phone one of your Congressman's district offices to request an opportunity to chat with him or her for a few minutes. You will likely be asked the purpose of your request and you may wish to refer to the ICCFA Speaking Points on HR 3655 at www.iccfa.com/files/HR3655speakingpoints.pdf. Chances are that your Rep will point out that he or she is not a member of the Energy and Commerce Committee, but in that case you should ask that they convey your opposition to members of the E&C Committee whom they know.

In your conversations with Reps or staff, you should inquire if they know the current status of this bill. If they do not, you can share what we know—that the bill may be considered during June. Also, if your Rep wants more information on HR 3655, please alert general counsel Bob Fells rfells@iccfa.com and it will be promptly provided. We should continue to communicate our opposition, build coalitions where we can, and persuade our colleagues in other associations to contact their leadership to urge opposition to the bill.

FTC Extends Enforcement Deadline for Identity Theft "Red Flags" Rule to

December 31, 2010

At the request of several Members of Congress, the Federal Trade Commission is further delaying enforcement of the "Red Flags" Rule through December 31, 2010, while Congress considers legislation that would affect the scope of entities covered by the Rule. Today's announcement and the release of an Enforcement Policy Statement do not affect other federal agencies' enforcement of the original November 1, 2008 deadline for institutions subject to their oversight to be in compliance.

"Congress needs to fix the unintended consequences of the legislation establishing the Red Flags Rule—and to fix this problem quickly. We appreciate the efforts of Congressmen Barney Frank and John Adler for getting a clarifying measure passed in the House, and hope action in the Senate will be swift," FTC Chairman Jon Leibowitz said. "As an agency we're charged with enforcing the law, and endless extensions delay enforcement."

The Rule was developed under the Fair and Accurate Credit Transactions Act, in which Congress directed the FTC and other agencies to develop regulations requiring "creditors" and "financial institutions" to address the risk of identity theft. The resulting Red Flags Rule requires all such entities that have "covered accounts" to develop and implement written identity theft prevention programs to help identify, detect, and respond to patterns, practices, or specific activities—known as "red flags"—that could indicate identity theft.

The Rule became effective on January 1, 2008, with full compliance for all covered entities originally required by November 1, 2008. The Commission has issued several Enforcement Policies delaying enforcement of the Rule. Most recently, the Commission announced in October 2009 that at the request of certain Members of Congress, it was delaying enforcement of the Rule until June 1, 2010, to allow Congress time to finalize legislation that would limit the scope of business covered by the Rule. Since then, the Commission has received another request from Members of Congress for another delay in enforcement of the Rule beyond June 1, 2010.

If Congress passes legislation limiting the scope of the Red Flags Rule with an effective date earlier than December 31, 2010, the Commission will begin enforcement as of that effective date. In the interim, FTC staff has continued to provide guidance, both through materials posted on www.ftc.gov/redflagsrule, and has also published a compliance guide for business, and created a template that enables low risk entities to create an identity theft program with an easy-to-use online form.

   

There has been some confusion over the effective date of the Federal Trade Commission's "Red Flags" Rule, which has been delayed several times. The latest—and probably final—word from the FTC is that enforcement of the "Red Flags" Rule will begin on June 1, 2010, for financial institutions and creditors subject to enforcement by the FTC. However, the terms "financial institution" and "creditor" are broadly defined and cover many retailers.
